Anthony Caffrey and Mike Smith obtain a voluntary dismissal after filing a motion for summary disposition for a condominium association client. Our client, a condominium association, was sued for breach of contract and other theories of liability based on the Plaintiff’s apparent dissatisfaction with the purchase of her condominium. We filed a motion for summary disposition based on the contract documents, public records, and admitted Requests to Admit, all of which confirmed the condominium association was not the proper Defendant. Confronted with the motion, Plaintiff ultimately agreed to voluntarily dismiss the condominium association from the suit without payment.
