CL Partners Carl Lanfear and Michael Smith along with Anthony Caffrey recently settled an indemnity case where they recovered $1.55 million for the client. The client settled the underlying personal injury claim but maintained that another company was liable for the settlement and defense costs due to an indemnity provision in the parties’ equipment rental agreement. The other party denied responsibility, ultimately resulting in CL filing suit to recover the amount paid out. After the Circuit Court granted summary disposition in favor of the Client, the parties facilitated and the Defendant agreed to pay the Client $1.55 million and waive any right to appeal the Circuit Court ruling.
