Discovery revealed that Plaintiff was in a room on the opposite side of the house when the accident occurred, and that Plaintiff had preexisting symptoms identical to those claimed in this case. The Court granted summary disposition based on a lack of evidence that Plaintiff sustained any injury in this case, let alone a serious impairment of an important body function, the threshold level injury necessary to make a third-party auto claim in Michigan. Conducting thorough discovery often reveals that Plaintiffs’ claims are fraudulent, exaggerated, or without legal merit.
