Trucking Law: Towing Operations Case

The firm was recently successful in defending a towing operation with respect to damage caused during the tow.  The property owner’s insurer sought to recoup insurance benefits paid under the Carmack Act; however, a federal district judge ruled that the Carmack Act’s “towing exception” applied to the facts of the matter.  For more information, see the trial court’s decision, as well as our analysis.
