Plaintiff claimed that Defendant was liable for injuries he sustained in an alleged assault in front of a home owned by Defendant. Plaintiff, a former romantic partner of Defendant, whose home he stayed at, claimed there was a landlord/tenant relationship and as such a special relationship existed giving rise to a duty to expedite police intervention. Defendant argued that no special relationship existed and even if one did, the duty was extinguished when a neighbor called the police during the altercation. The Court granted summary disposition on all counts.
