Another appellate victory for the Cardelli Lanfear appellate team! The Michigan Court of Appeals affirmed a trial court order granting summary disposition in a premises liability case at a well-known and highly frequented entertainment location. Although the Court of Appeals could not affirm based on the changes in the law regarding “open and obvious,” the Court of Appeals did affirm with respect to Plaintiff’s intoxication being more than a 50% cause of her own injuries. The Court of Appeals also agreed with arguments regarding the admissibility of key documents created in the aftermath of the incident.
