They successfully obtained dismissal after demonstrating that the plaintiff did not satisfy Michigan’s threshold injury requirement. Although summary disposition on this issue can be difficult to obtain, the court found that the plaintiff’s pre-existing knee condition and planned surgery predated the accident and that the plaintiff failed to establish a qualifying injury caused by the collision.
The court also concluded that the plaintiff did not demonstrate an effect on his ability to lead his normal life, noting that his only claimed post-accident limitation was playing with his grandchildren, while evidence showed he was already unable to perform household chores or work before the accident.
