Partner Bob Kaatz Wins Summary Disposition

Plaintiff’s failure to disclose his personal injury claim results in dismissal of this lawsuit under the theory of judicial estoppel.  Plaintiff’s prior bankruptcy was revealed during discovery. The fact that Plaintiff previously asserted to another court (the Bankruptcy court) that he had no personal injury claims barred him from later bringing said claim in a different court.  As such, we filed a motion for summary disposition and the court agreed with our position (and longstanding Michigan law) dismissing all of Plaintiff’s claims.
